For most departments, commissions and other bodies of the WA Government, the standard WA tender form often applies as the means for response to any Request for Tender.
Listed below is the main structure of these forms and general questions that are usually found, regardless of the tender’s requirements and government organisation running the tender.

Identity of Respondent
The first section of many WA government tenders concerns the supply of basic information for the tenderer and their business. Having the most, recent up to date information at one’s fingertips will allow you to fill this in quickly and move on to the more substantial sections just ahead.
Info to provide;
- Business name and Legal entity name (if applicable)
- Contact details (Business address, email, phone number)
- ABN/ACN
Compliance Requirements
As per the previous section, the compliance and disclosure requirements maintain that all tenderers must comply with the Head Agreement, Customer Contract and General Conditions details respectively.
For most tenderers, a simple ‘Yes’ will suffice to answer these questions. But for other applicants, The Tender Team will be able to advise on what exactly needs to be written in these sections if there are clauses that our prospective or current clients may not be able to agree to.
In these circumstances, we encourage all clients to clearly set out each clause of the Head Agreement, Customer Contract or General Condition that they can’t comply with for any of the reasons listed below;
- Lack of operational capacity
- Personal/Ethical grounds
- Timing of tender requirements and others
As an alternative, The Tender Team always encourages our clients to provide an alternative clause or other condition that counteracts failure to comply with any conditions set out by the government organisation.
For example, if the tender requires the business to be available on contingency during a certain time period such as for a month in later 2016 and the tenderer can’t abide by that availability, they can propose an alternative month as permitted by the government organisation. While there is no guarantee that such a clause will be permitted, it is often the most appropriate way to respond to tender requirements that may prove less than ideal.
Disclosure Requirements
For many WA government tenders, disclosing certain relationships and characteristics of the business and its operations is mandatory.
The following arrangements are usually enquired by these tenders as part of the response;
- Are you acting as an agent or trustee for another individual/business?
- Are you acting jointly or in association with another individual/business?
- Have you incurred any criminal convictions (as an individual or within the business)?
- Is there a conflict of interest (potential/actual/perceived) between the tender requirements and your business operations?
The Tender Team is able to advise you on any difficulties in considering whether or not you fall under any of the aforementioned arrangements. For most tenderers, however, it will be a simple ‘Yes’ or ‘No and explain’ response to most questions within this section.
Qualitative Requirements
The qualitative requirements of WA government tenders are how a tenderer can distinguish themselves from the competition. In this section, our clients must be able to clearly set out how they hope to fulfill all tender requirements using their own experience, manpower and resources.
They normally consist of three major subsections;
- Capacity and suitability to provide services
- Specified personnel
- Demonstrated experience
The capacity and suitability to provide services is a major section of these tenders. The Tender Team assist our clients with these responses by consulting on each response and formulating answers that are both coherent and clearly planned out.
In this section, it is important to demonstrate the link between how adequately our client is able to fulfill a government organisations’ needs for specific services and/or products. Tailoring facts and case studies for each question asked in this section is important and being able to showcase how our client can fulfill each requirement with as little intervention required as possible is a net positive to any government evaluation panel.

For those clients however who may lack an extensive array of previous clients and are aiming to make the transition to those larger contracts, The Tender Team prides ourselves in our ability to portray these clients in the best manner possible.
Our responses are designed to portray our more inexperienced clients positively but accurately. In other cases, some tenderers may decide to align their tender response with another company as a subcontractor or in a joint venture. In doing so, The Tender Team are able to reinforce how gaps in experience can be overcome by this arrangement and that the government organisation can rely on the combined resources of two bidders over another application with only one.

Local Content
As with many government organisations, there is an emphasis on whether the services and/or products being provided are based within Australia and more specifically, in WA.
This section seeks to emphasise that many evaluation panels place importance on tenderers whose business activities not only fulfill the tender requirements but do so while encouraging economic growth and other activity locally.
The Tender Team recommends our WA-based clients showcase how deeply involved their businesses are in not only economic growth for the state but community events and other initiatives (such as apprenticeships, training and seminars) that they may be currently conducting.
While certain clients may not have the inclination, resources or time to conduct these activities, The Tender Team will still assist in providing a planned response that indicates a future shifting of business activities or sourcing within WA on a local level to our client’s agreement.
Tender Schedules
All tenderers must be aware of these tender schedules and the conditions they set out for all aspects of the tender from planning to implementation to review.
The Head Agreement and Customer Contract schedules state each clause and any other relevant information that the tenderer must be aware of both during and after they have submitted their tender response. This period also extends to fulfilling the contract itself should their tender response be successful.
The Specification schedule changes depending on the government organisation and the services and/or products needed for fulfillment. The Tender Team peruses this section closely so as to properly construct responses that incorporate the specification requirements alongside our clients’ set of skills, experience and resources.
While The Tender Team does not consult on Pricing Schedules for WA government tenders, we however advise all clients to have their pricing properly sorted well before the submission date. This aspect of the tender is highly important and it requires 100% accuracy if verification of the figures provided are requested later once our client moves on to the next stage of the tendering process.
